The Emoluments Clause and Trump’s Violations

The Brookings Institute, “Never in American history has a president-elect presented more conflict of interest questions and foreign entanglements than Donald Trump. Given the vast and global scope of Trump’s business interests, many of which remain shrouded in secrecy, we cannot predict the full gamut of legal and constitutional challenges that lie ahead.  But one violation, of constitutional magnitude, will run from the instant that Mr. Trump swears he will “faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.” While holding office, Mr. Trump will receive—by virtue of his continued interest in the Trump Organization and his stake in hundreds of other entities—a steady stream of monetary and other benefits from foreign powers and their agents.”[1]

The Heritage Foundation, “Article VI of the Articles of Confederation was the source of the Constitution’s prohibition on federal titles of nobility and the so-called Emoluments Clause. The clause sought to shield the republican character of the United States against corrupting foreign influences.”[2]

Kuwait – Trump Conflict of Interest

Think Progress, “The Embassy of Kuwait allegedly cancelled a contract with a Washington, D.C. hotel days after the presidential election, citing political pressure to hold its National Day celebration at the Trump International Hotel instead.”[1]

Congressman Jim McGovern (D-MA) Letter criticizes the Trump Organization for such a private dealing with a repressive government.[2]

Trump’s Conflict of Interests – Is Trump Ethical?

President Elect Donald Trump seems to think that he can use his office as President to help his businesses across the globe. Only 12 days after winning the election, he has already tried to ask for a favor from the British Prime minister and has had his daughter Ivanka in meetings with two world leaders without as much as a security clearance. The Hypocrisy is staggering after Trump and his goons hounded Hillary Clinton with a mythical “Pay to Play” conspiracy theory over her involvement with the Clinton foundation. The question once again has to be raised, does Trump want to be President? Is it possible that he will use his office to secure a few favors and then leave Mike Pence holding the bag.
